Section 01

Privacy Policy

50 Shades of Paid International, LLC (referred to as "we," "us," or "our") operates 50shadesofpaid.com and kadenatate.com (the "Site"). This Privacy Policy explains what personal information we collect, how we use and share it, and the rights you have regarding your information. By using the Site, you agree to the collection and use of information in accordance with this policy.

Information We Collect

We collect two categories of information when you interact with the Site.

Information You Provide Directly

This includes your first and last name, email address, billing address, phone number, payment details (processed by our payment providers, not stored on our servers), responses to diagnostic tools and intake forms, items you save to your profile, and anything you choose to share in a comment, testimonial, or direct message to us.

Information Collected Automatically

When you visit the Site, your browser automatically sends information we log, including IP address, browser type and version, operating system, referring URLs, pages viewed, time spent on pages, clicks, and general device information. We also use cookies and similar tracking technologies (see Section 06 below for details).

How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the Site and our services
  • Generate your diagnostic results and save them to your profile
  • Fulfill orders, deliver products, and provide customer support
  • Communicate with you about your account, purchases, and inquiries
  • Send marketing emails and newsletters (only if you have opted in)
  • Personalize your experience and improve the Site
  • Detect, prevent, and address fraud, security, and technical issues
  • Comply with legal obligations and enforce our terms

How We Share Your Information

We do not sell, rent, or trade your personal information. We share limited information only in these circumstances:

  • Service providers. Third-party vendors who perform services on our behalf (payment processing, email delivery, analytics, hosting, and customer relationship management). These vendors are bound by contractual obligations to handle your data securely and only for the purposes we direct.

  • Business transfers. If we are involved in a merger, acquisition, financing, or sale of all or part of our business, your information may be transferred as part of that transaction.

Data Retention

We retain personal information for as long as your account is active, as needed to provide services, or as required to comply with legal obligations, resolve disputes, and enforce agreements. When information is no longer needed, we delete or anonymize it.

Data Security

We use commercially reasonable administrative, technical, and physical safeguards to protect your information, including encryption in transit, secure payment processing, and access controls. However, no method of transmission over the internet is 100 percent secure. You acknowledge and accept this inherent risk when using the Site.

Your Rights and Choices

Regardless of where you live, you may contact us to request access to, correction of, or deletion of your personal information. You can also unsubscribe from marketing emails at any time using the unsubscribe link in any message or by contacting us directly. Residents of certain jurisdictions have additional rights described in Sections 03, 04, and 05 below.

Children Under 16

The Site is not directed to children under 16. We do not knowingly collect personal information from anyone under 16. If you believe we have collected such information, please contact us and we will delete it promptly.

International Users

The Site is operated from the United States. If you access the Site from outside the United States, your information will be transferred to, stored, and processed in the United States, which may have different data protection laws than your country of residence.

Changes to This Policy

We may update this Privacy Policy from time to time. The "Effective Date" at the top of this page reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the revised policy.

Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Site, and any products, services, programs, memberships, diagnostics, digital downloads, or community offered by 50 Shades of Paid International, LLC. By accessing the Site or purchasing anything from us, you agree to be bound by these Terms. If you disagree with any part, do not use the Site.

Our Products and Services

Our offerings include a free public Directory, a free Growth Profile account (when available), and one paid product: the 50 Shades of Paid® Membership, billed at $497 per year. The Membership begins with The Growth Decision, a personalized strategic evaluation, and continues as an annual membership with the features described at the time of your purchase. The Membership renews annually at the then-current price. Renewal terms, the renewal date, and the cancellation method are disclosed before you pay, and you will receive notice before any renewal charge. You may cancel at any time; access continues through the end of the paid term. There are no monthly plans and no separate paid diagnostic products.

Intellectual Property

All content on the Site, including but not limited to text, frameworks, methodologies (such as the 50 Shades of Paid framework), diagnostic tools, the directory and its records, writing, graphics, logos, images, audio, video, software, and the selection and arrangement of these elements, is owned by us or our licensors and protected by United States and international copyright, trademark, and other intellectual property laws.

You may view and use content for your own business, subject to these Terms. You may not reproduce, distribute, modify, publicly display, sell, license, scrape, bulk-download, or create derivative works from any content without prior written permission, except as permitted under Sections 107 or 108 of the 1976 United States Copyright Act (fair use). Member tools are designed to be used interactively and are not intended for extraction of underlying content. Requests for permission can be sent to kadena@kadenatate.com.

Use of Site Content

All content on this Site is for informational and educational purposes only. We make no guarantees regarding the accuracy, completeness, or usefulness of any information. Your reliance on Site content is entirely at your own risk. Nothing on the Site constitutes legal, accounting, tax, medical, or other professional advice.

User-Generated Content

If you post comments, reviews, testimonials, or other content on the Site or on our social media accounts, you retain ownership of that content but grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, display, and distribute it in connection with our business. You are solely responsible for content you submit and represent that you have the right to share it. We reserve the right to remove any content we determine is unlawful, offensive, or in violation of these Terms.

Purchases

When you purchase products or services, you agree to provide accurate, current, and complete information and to pay all fees associated with your order. All prices are in United States dollars unless stated otherwise. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud or pricing errors.

Account Security

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.

Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to any portion of the Site or related systems
  • Interfere with or disrupt the Site, servers, or networks connected to the Site
  • Use automated scraping, data mining, or similar extraction tools without permission
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

Termination

We may suspend or terminate your access to the Site or any program at any time, with or without notice, if we believe you have violated these Terms or engaged in harmful conduct. Upon termination, your right to use the Site ceases immediately.

Warranty Disclaimer

The Site and all content are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted service. We do not warrant that the Site will be error-free or that defects will be corrected.

Limitation of Liability

To the fullest extent permitted by law, in no event will we, our affiliates, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Site or any products, including but not limited to lost profits, lost revenue, lost data, or business interruption, even if advised of the possibility of such damages. Our total cumulative liability to you for any claim will not exceed the amount you paid us in the 12 months preceding the claim, or 100 United States dollars, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless 50 Shades of Paid International, LLC and its officers, employees, and agents from any claim, liability, loss, or expense (including reasonable attorney fees) arising from your violation of these Terms, misuse of the Site, or infringement of any third-party rights.

Third-Party Links

The Site may contain links to third-party websites. We do not control and are not responsible for the content, privacy practices, or availability of third-party sites. Accessing them is at your own risk.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction of those courts.

Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

Changes to These Terms

We may revise these Terms from time to time. The "Effective Date" at the top of this page reflects the most recent version. Continued use of the Site after changes means you accept the revised Terms.

GDPR Rights (EU and UK Residents)

If you are located in the European Economic Area (EEA), the United Kingdom, or Switzerland, the General Data Protection Regulation (GDPR) and the UK GDPR grant you specific rights regarding your personal data. This section explains those rights and how to exercise them.

International Data Transfers

When we transfer personal data from the EEA, UK, or Switzerland to the United States, we rely on appropriate safeguards such as Standard Contractual Clauses approved by the European Commission or other legally recognized transfer mechanisms.

CCPA Notice (California Residents)

If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), gives you specific rights regarding your personal information. This section supplements our Privacy Policy with CCPA-specific disclosures.

In the past 12 months, we may have collected the following categories of personal information:

Do Not Sell or Share

We do not sell your personal information for money. We do not share personal information for cross-context behavioral advertising. If this changes, we will update this notice and provide an opt-out mechanism.

How to Submit a Request

To exercise your CCPA rights, email kadena@kadenatate.com with "CCPA Request" in the subject line. We will verify your identity and respond within 45 days as required by law. Authorized agents may submit requests on your behalf with proper documentation.

Texas TDPSA Disclosures

The Texas Data Privacy and Security Act (TDPSA) took effect July 1, 2024. If you are a Texas resident, this section explains the additional rights and disclosures that apply to you.

Your Texas Privacy Rights

As a Texas resident, you have the right to:

  • Confirm whether we are processing your personal data and access that data
  • Correct inaccuracies in your personal data
  • Delete personal data we have collected from or about you
  • Obtain a copy of your personal data in a portable format
  • Opt out of the processing of personal data for purposes of targeted advertising, the sale of personal data, or profiling that produces legal or similarly significant effects

Processing of Sensitive Data

We do not process "sensitive data" as defined by the TDPSA (such as racial or ethnic origin, religious beliefs, health information, biometric data, or precise geolocation) without your consent.

Sale of Personal Data

We do not sell personal data for monetary consideration. If our practices change, we will notify Texas residents and provide a clear opt-out.

Targeted Advertising

We do not engage in targeted advertising that requires opt-out under the TDPSA. If this changes, we will disclose the activity and provide an opt-out mechanism.

Appeals

If we decline to take action on your request, you may appeal within a reasonable period. We will respond to appeals within 60 days. If your appeal is denied, you may contact the Texas Attorney General to submit a complaint.

Refund and Return Policy

Our refund policy depends on the type of product or service purchased. Please review the specific terms at checkout before completing your order. If the product or service page does not specify different terms, the policies below apply.

Digital Products

Due to the immediate delivery and intellectual property nature of digital products (including canvases, templates, and downloadable resources), where offered separately, all sales are final and non-refundable once access has been delivered. Please review product descriptions carefully before purchasing.

Memberships

The 50 Shades of Paid® Membership is billed annually at $497 and renews each year until you cancel. Cancellation stops future billing; access continues until the end of your current paid term, after which access to member tools, guides, and resources ends. A full refund is available if you request it before your Growth Decision has meaningfully begun. Once the personalized Growth Decision is underway or your Dossier has been generated, refunds are not routinely provided, except where required by law. We do not provide pro-rated refunds for unused time.

Physical Products

If we offer physical products, they may be returned within 14 days of delivery in unused, original condition. Return shipping is the customer's responsibility unless the product was defective or shipped incorrectly. Contact us to initiate a return.

How to Request a Refund

To request a refund where eligible, email kadena@kadenatate.com with your order number, the product or service name, and the reason for your request. We will respond within 5 business days.

Chargebacks

We ask that you contact us before initiating a chargeback with your bank or credit card company. Disputes filed without first contacting us may be contested with the provided evidence of delivery and terms accepted at checkout.

DMCA Copyright Notice

Repeat Infringers

We reserve the right to terminate accounts of users who repeatedly infringe copyrights.

False Claims

Knowingly filing a false DMCA notice may result in liability for damages, including costs and attorney fees, under Section 512(f) of the DMCA.

The information you enter into AI-enabled features may be processed by our systems and trusted service providers to generate your results, and is handled in accordance with our Privacy Policy. We do not sell your data. We take reasonable steps so that your inputs are used to serve you, and we do not permit your personal information to be used to train unrelated third-party models without appropriate safeguards.

Fairness and Bias

AI can reflect biases present in the data it was trained on. We work to reduce unfair or discriminatory outcomes in our tools, and we welcome reports of any output that appears biased or inappropriate so we can review and improve.

Security
